Court Rules School Districts in California Can’t Mandate Vaccines

The ruling comes following a legal challenge to the San Diego Unified School District’s attempt to mandate COVID-19 vaccines for students ages 16 and older. It marks the first ruling by a state appeals court and will be binding on lower courts statewide unless overturned by the California Supreme Court or contradicted by another appeals court.

In Sept. 2021, the San Diego district, which is California’s second largest school district, proposed requiring its older students to be vaccinated against COVID-19 in order to attend classes and participate in sports and other in-person events. The proposed mandate would allow for medical exemptions but not religious or personal ones. Later, the district announced it would postpone any mandate until at least July 2023.

“The Legislature has mandated that public health officials — not school authorities — determine the disease(s) for which vaccinations are required,” the California 4th District Court of Appeal in San Diego stated on Tuesday.

California requires schoolchildren to be vaccinated against 10 communicable diseases, including measles, mumps, chicken pox, polio and rubella. The appeals court noted state law allows the California Department of Public Health to add diseases to that list, but it does not expressly authorize local agencies to do so.

    Since kids are in more danger from the jab than the virus,that ruling should include prohibiting the state from mandates. Hopefully the court will follow the science and not politics the next time.

  3. The state will wait for an opportune moment, then they will mandate it.

  4. Another reason to Homeschool. Not only will your child be a scholar, but they would be safer in a pod of children of your choosing than throwing them to the bullies, sexual groomers, SEIU bigots, poor curriculum, horrible teachers and wasting the time of your precious child. They can’t even teach math, read important books that are now banned and learn true science not globally integrated climate change hysterical rantings where other scientists are not allowed different perspectives and introducing data that could corroborate their findings. Common core curriculum accepted into California for the millions it dumped into their coffers does nothing more than confuse your child with zip results. When graduating with a D is acceptable, we are all in trouble. Since when did Mediocrity become the norm instead of exceptionalism? Bill Gates pushed the mRNA treatment on your precious ones, and he also indoctrinated the common core crap.

      I would like to disagree with you and point out how good our schools are for our children.

      But I can’t. The ONLY thing we can do is insist they actually do the work, try to instill some sense that skating is a sport not for school classes and insist the groomers are no where near our school boards or classrooms. We might want to start with the Governor.

  5. I was very fortunate back in the mid 80’s and 90’s to have landed a better job and got my kids out of public school as soon as I could. I feel bad for the parents today, but if they’re anything like the lazy parents of the last generation………you deserve this EVIL society and their satanic brainless eduactional system!!!
